Part 1 covered public relations and advertising agencies. Each post in this series focuses on the financial pressure points, metrics, and oversight practices specific to one industry.

Every law firm tracks revenue. The firms that build lasting financial strength track three things more carefully: realization, utilization, and trust. Here is what each one means, why each one matters, and what strong oversight looks like across all three.

Law firms operate at the intersection of professional obligation and business reality. The legal work is the product. But the financial infrastructure around it determines whether the firm is actually profitable, by how much, and whether that profitability is sustainable.

Many firms, particularly small to mid-size practices, underinvest in financial oversight. Finance gets treated as a back-office function right up until a trust account discrepancy, a collections problem, or a partner compensation dispute forces the conversation.

The firms that build lasting financial strength organize that oversight around three pillars: realization, utilization, and trust. Here is what each one means and what active management looks like in practice.

Pillar One: Trust — The Non-Negotiable Foundation

Trust accounting is not just a financial management issue. It is a professional responsibility obligation. Client funds held in trust must be segregated, tracked, and reconciled with a level of precision that goes beyond standard bookkeeping.

Errors in trust accounting, even unintentional ones, carry serious consequences including bar complaints, disciplinary proceedings, and in extreme cases, disbarment. The standard is not reasonable accuracy. It is exact accuracy, with contemporaneous records.

Strong trust account management requires a clear process for recording deposits and disbursements, regular three-way reconciliations between the trust ledger, client ledgers, and bank statements, and someone who reviews reconciliations independently from the person performing them. For firms without dedicated accounting staff, this is an area where outsourced support and the right software are not optional.

Trust in Practice: Three-Way Reconciliation and Compliance

The practical execution of trust accounting comes down to one process done consistently: the three-way reconciliation. This means matching the trust account bank statement, the firm’s trust ledger, and the individual client ledger balances, and confirming that all three agree at the same point in time. Most state bar rules require this reconciliation to be performed monthly.

The reconciliation should be performed by someone with accounting competence and reviewed independently from the person who performs it. For many small to mid-size firms, this is where outsourced accounting support or a fractional CFO adds immediate and measurable value. The cost of a trust accounting error, measured in professional discipline risk, is not proportional to the cost of the oversight that prevents it.

A purpose-built legal practice management platform with trust accounting functionality, such as Clio or MyCase, significantly reduces the risk of error by automating the ledger entries that flow from case activity and flagging reconciliation discrepancies before they compound. But the software is only as reliable as the inputs. Consistent recording of every deposit and disbursement, at the time it occurs, is the discipline that makes the reconciliation meaningful.

Pillar Two: Realization — The Gap Between What You Bill and What You Keep

Most law firms set billing rates but very few actively manage their realization rate, the percentage of billed time that is actually collected after write-downs, write-offs, and discounts. A firm billing at $400 per hour but realizing $300 after adjustments is not operating at its stated rate. It is operating at 75 cents on the dollar, and the gap between those two numbers tells an important story about pricing discipline, client relationships, and firm profitability.

The questions worth asking regularly: what is the firm’s realization rate by practice area, by attorney, and by client? Where are the largest write-downs occurring and why? Are rates being reviewed annually against market and against the actual cost of delivering legal services at this firm? And are the right attorneys doing the right work at the right rate, or is senior attorney time being consumed by work that could and should be done at a lower level?

Realization in Practice: Work in Progress and Collections

Law firm cash flow is driven by two numbers: how quickly work gets billed after it is performed, and how quickly invoices get paid after they are sent. Both deserve active management.

Work in progress, the value of time recorded but not yet billed, represents earned revenue sitting in a holding pattern. Firms that allow Work in Progress to accumulate for 60 or 90 days before billing are extending an unintentional line of credit to their clients and creating cash flow gaps that do not need to exist. Regular billing cycles, defined by matter type or by calendar, are a financial discipline issue as much as an operational one.

On the collections side, accounts receivable aging by client and by matter is the most important financial report in most firms. Who owes what and for how long? Which accounts are trending toward write-off? Which clients have a pattern of slow payment that needs to be addressed before the next matter opens? A CFO or financial manager reviewing AR aging monthly, and escalating when needed, catches collection problems while they are still solvable.

Pillar Three: Utilization — Who Is Doing What, at What Rate, for Which Clients

Utilization measures how productively the firm is deploying its most valuable and expensive resource: attorney and staff time. It is not simply about being busy. It is about whether the right people are doing the right work at the right level, and whether that work is being captured, billed, and collected at the rate the firm needs to be profitable.

The key utilization metrics worth tracking regularly: what percentage of available attorney time is being spent on billable work vs. administrative, business development, or non-billable activities? Are senior attorneys spending time on work that should be delegated to associates? Are associates being deployed efficiently across the matter portfolio, or are some chronically under-allocated while others are stretched? And is the blended rate across the firm’s attorney population consistent with the firm’s pricing model?

Utilization also connects directly to partner economics. Compensation structures that do not align with actual contribution, whether through an eat-what-you-kill model, a lockstep arrangement, or something in between, affect how attorneys deploy their time and how the firm allocates its capacity. Partner draws, capital contributions, and profit distributions all need to be structured with the firm’s utilization picture and cash flow position in mind.

Utilization in Practice: Client Concentration and Matter Profitability

A single client representing a significant portion of a firm’s revenue is a financial risk that deserves the same attention in a law firm as in any other service business. Client relationships in law can feel durable and long-standing right up until they are not. A relationship change, a client acquisition, an in-house shift, or a billing dispute can alter the revenue picture quickly.

Equally important is matter-level profitability. Not all clients and not all matters are equally profitable. A large client that demands significant write-downs, requires extensive senior attorney time, or generates collections problems may be less valuable than it appears. Knowing the profitability of each significant matter and each significant client relationship gives the firm’s leadership the information it needs to make good decisions about where to invest capacity.

The Role of Practice Management Software: Clio and 8am/MyCase

The three pillars above are significantly easier to manage when the firm is running on a purpose-built legal practice management platform. Two of the most widely adopted platforms in the small to mid-size firm market are Clio and MyCase, now operating under the 8am brand alongside LawPay.

Clio is the market leader, used by more than 150,000 legal professionals and approved by over 100 bar associations worldwide. It is built around a flexible, integration-first philosophy that works well for firms with dedicated operations staff who want to build a customized technology stack. From a financial management perspective, Clio centralizes time entries, billing and invoice management, trust accounting with three-way reconciliation support, accounts receivable tracking, and reporting that connects activity to financial outcomes across all three pillars.

MyCase, part of the 8am family of legal technology products that includes LawPay, is a strong alternative for smaller firms and those prioritizing ease of use and value. It offers an all-in-one platform covering case management, billing, time tracking, trust accounting, and client communication in a single system with a gentler learning curve. Its native integration with LawPay simplifies IOLTA-compliant trust accounting and operating account workflows, and it connects to QuickBooks Online for firms that want a separate accounting layer.

The right platform depends on firm size, practice area, existing technology relationships, and how much customization the firm actually needs. What matters most from a financial oversight standpoint is not which platform is selected but whether the firm is using it fully. A firm that captures time consistently, reconciles trust monthly, and reviews realization and collection reports regularly will outperform one with a superior platform and inconsistent discipline.

Software supports financial discipline. It does not create it.

What Strong Financial Oversight Actually Looks Like

The law firms that navigate these challenges well share a common characteristic: financial oversight is treated as a management function, not an administrative one. Someone is reviewing trust reconciliations every month. Someone is watching realization and collection rates by attorney and by client. Someone is modeling cash flow forward and flagging when Work in Progress aging or AR trends signal a problem.

For firms that are not yet at the size to justify a full-time CFO, a fractional CFO who understands the law firm model can provide that level of oversight without the full-time overhead. Combined with a platform like Clio that puts the right data in one place, the financial picture of the firm becomes something leadership can actually act on, rather than a set of reports that arrive too late to change anything.

Ascend Accounting Advisory works with law firms as a fractional CFO and outsourced accounting partner.
